BETBOX TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of BetBox kiosks, websites, applications, text messaging services, customer-support services, and related products and services.

The BetBox services are provided by BetBox Kiosk, Inc. (“BetBox,” “we,” “us,” or “our”).

By accessing or using a BetBox service, you agree to these Terms and acknowledge the BetBox Privacy Policy. If you do not agree, you must not use the BetBox services.

1. Eligibility

You may use BetBox only if:

  1. You are at least 18 years old;

  2. You have the legal capacity to enter into a binding agreement;

  3. Your use is lawful in the location where you use BetBox;

  4. You satisfy any additional age or eligibility requirement applicable to the selected product; and

  5. You are not prohibited from using the selected financial, payment, gaming, or wagering service.

Sports wagering products and services may be restricted to persons who are at least 21 years old and physically located in an authorised jurisdiction. The requirements of the relevant sportsbook or product provider also apply.

2. BetBox Services

BetBox provides technology that may allow eligible users to:

  • Use cash at a participating kiosk;

  • Purchase, activate, or fund eligible third-party products;

  • Receive transaction links or confirmations;

  • Access prepaid or payment card products;

  • Communicate with customer support; and

  • Use other services made available through a BetBox kiosk or digital interface.

The products available through a kiosk may vary by location, provider, legal requirements, and system availability.

3. BetBox Is Not a Sportsbook

Unless expressly stated otherwise, BetBox is not a sportsbook, casino, wagering operator, or operator of a game of chance.

Any wagering account or wagering service is provided by the relevant licensed third-party operator. BetBox does not:

  • Accept or settle wagers;

  • Establish betting odds;

  • Determine betting outcomes;

  • Control a sportsbook account;

  • Guarantee acceptance of a deposit by a sportsbook; or

  • Guarantee the availability or legality of a third-party wagering service.

Your relationship with a sportsbook or gaming operator is governed by that operator’s own terms, privacy policy, eligibility requirements, geolocation controls, responsible-gaming requirements, and dispute procedures.

4. User-Initiated Transactions

You are responsible for reviewing all transaction details before inserting cash or confirming a transaction.

Before completing a transaction, you should verify:

  • The selected product;

  • The recipient mobile number or account;

  • The amount;

  • The applicable fee;

  • Any minimum or maximum load requirement; and

  • Any product-specific restrictions.

Once cash has been accepted and a transaction has been successfully processed, the transaction may be final and non-refundable except where:

  • Required by law;

  • The transaction failed due to a verified BetBox system error;

  • The applicable product provider authorises a reversal; or

  • BetBox’s separately published refund or error-resolution policy provides otherwise.

BetBox cannot provide cash change through a kiosk unless the kiosk expressly states otherwise.

5. Fees

Fees will be disclosed before you confirm a transaction.

Fees may include:

  • Kiosk service fees;

  • Product activation fees;

  • Card program fees;

  • Network or processing fees; and

  • Fees imposed by a third-party provider.

By confirming a transaction, you authorise the disclosed fee. Additional fees may be imposed by a card issuer, financial institution, ATM operator, sportsbook, wireless carrier, or other third party.

6. Mobile Telephone Numbers

When you provide a mobile telephone number, you represent that:

  1. The number is accurate;

  2. You own the number or are authorised to use it;

  3. You are authorised to consent to messages sent to the number; and

  4. You will notify BetBox or update your information if you stop using the number.

You must not enter another person’s mobile number without that person’s permission.

7. BetBox Text Messaging Terms

7.1 Program Description

The BetBox text messaging program may send messages relating to:

  • User-initiated transactions;

  • Transaction links or digital product delivery;

  • Receipts and confirmations;

  • Account or card servicing;

  • Identity or security verification;

  • Fraud or security alerts;

  • Customer support;

  • Operational notices; and

  • Promotional communications where the recipient has separately opted in.

The actual messages sent will depend on the service you request and the consent you provide.

7.2 Consent

By providing your mobile number and taking the applicable affirmative opt-in action, you consent to receive the messages described in the consent disclosure presented to you.

Consent applies only to BetBox and the specific categories of messages described when you opt in. Your consent is not sold, rented, or transferred to another business.

Consent to receive recurring promotional messages is optional and is not a condition of purchasing or using a BetBox product or service.

Consent for promotional messages must be provided separately from consent for informational, transactional, security, or customer-service messages.

7.3 Message Frequency

Message frequency varies based on:

  • Your transactions;

  • Your account activity;

  • Customer-support interactions;

  • Security events; and

  • Whether you have separately opted in to recurring promotional messages.

7.4 Message and Data Rates

Message and data rates may apply. Your wireless carrier may charge you for messages sent to or received from BetBox.

7.5 Opting Out

You may opt out at any time by replying STOP to a BetBox message.

BetBox may send one final text confirming that your request has been processed. After that confirmation, BetBox will not send further messages covered by the withdrawn consent unless you provide new consent.

BetBox may also recognise other standard opt-out requests, including CANCEL, END, OPTOUT, QUIT, REVOKE, STOPALL, or UNSUBSCRIBE.

7.6 Help

7.7 Delivery

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to wireless-network availability, carrier filtering, system availability, and the accuracy of the mobile number provided. BetBox does not guarantee that any message will be delivered within a particular time.

You should retain any printed receipt or transaction reference provided by the kiosk.

7.8 Privacy of Mobile Information

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

Mobile information may be processed by service providers acting solely on BetBox’s behalf to deliver messages, provide customer support, prevent fraud, or comply with law. Those providers may not use the information for their own marketing.

8. Third-Party Products and Services

BetBox may facilitate access to products issued, processed, or operated by third parties.

Third-party products may be subject to separate:

  • Terms and conditions;

  • Privacy policies;

  • Fees;

  • Expiration rules;

  • Transaction limits;

  • Identity-verification requirements;

  • Geographic restrictions;

  • Refund rules; and

  • Customer-support procedures.

BetBox is not responsible for a third party’s independent decision to reject, delay, freeze, suspend, limit, or close an account or transaction.

9. Payment Card Products

Any prepaid, debit, or payment card made available through BetBox may be issued by a separate financial institution and managed by a separate program manager or processor.

The cardholder agreement, fee schedule, privacy notice, and other disclosures supplied with that card govern the card product. If those documents conflict with these Terms regarding operation of the card, the card-specific documents control.

10. User Responsibilities

You agree that you will not:

  • Use BetBox for an unlawful purpose;

  • Provide false or misleading information;

  • Use another person’s identity, mobile number, card, or account without authority;

  • Structure transactions to avoid transaction limits or compliance controls;

  • Attempt to launder money or disguise the source of funds;

  • Interfere with a kiosk, network, website, application, or security feature;

  • Introduce malicious software;

  • Attempt to access another user’s information;

  • Reverse engineer or tamper with BetBox software or hardware;

  • Damage, obstruct, move, or misuse a kiosk;

  • Use automated means to access BetBox without permission; or

  • Use BetBox in violation of a sportsbook’s, issuer’s, processor’s, or product provider’s rules.

BetBox may refuse or delay a transaction where reasonably necessary to investigate suspected fraud, misuse, technical errors, sanctions concerns, money laundering, or legal or regulatory requirements.

11. Transaction Limits and Verification

BetBox and its service providers may impose limits based on:

  • Mobile number;

  • Customer identity;

  • Kiosk;

  • Venue;

  • Product;

  • Transaction amount;

  • Time period;

  • Risk indicators; or

  • Applicable legal and partner requirements.

We may request additional information or identification before processing or releasing a transaction.

A transaction may be delayed, declined, cancelled, or reported where required for fraud prevention, sanctions screening, anti-money-laundering compliance, or other legal obligations.

12. Intellectual Property

The BetBox name, logos, kiosk interface, software, content, designs, graphics, and related materials are owned by BetBox or its licensors and are protected by applicable intellectual-property laws.

BetBox grants you a limited, personal, revocable, non-exclusive, and non-transferable right to use the services for their intended purpose.

No BetBox software, content, or branding may be copied, modified, distributed, sold, licensed, reverse engineered, or commercially exploited without written permission.

13. Service Availability

BetBox may modify, suspend, restrict, or discontinue any service, kiosk function, product, or location.

Service availability may be affected by:

  • Internet or mobile-network outages;

  • Cash acceptor or kiosk malfunctions;

  • Power interruptions;

  • Maintenance;

  • Third-party system failures;

  • Product availability;

  • Regulatory restrictions;

  • Fraud-prevention controls; or

  • Events outside BetBox’s reasonable control.

BetBox does not guarantee uninterrupted or error-free operation.

14. Disclaimers

To the fullest extent permitted by law, BetBox services are provided on an “as is” and “as available” basis.

BetBox disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, and error-free operation.

BetBox does not guarantee:

  • Acceptance of a transaction by a third party;

  • Availability of any particular product;

  • Delivery of a text message within a specific time;

  • Approval of a sportsbook deposit;

  • The operation of a sportsbook or third-party account;

  • The accuracy of third-party content; or

  • Any wagering, financial, or other outcome.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, BetBox and its officers, directors, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, opportunities, data, account access, or anticipated winnings.

BetBox is not liable for losses arising from:

  • Incorrect information entered by a user;

  • Use of another person’s mobile number or account;

  • A third-party product or service;

  • A sportsbook’s actions or decisions;

  • Wireless-carrier delays or filtering;

  • Unauthorised access caused by a user’s failure to protect credentials;

  • A failure to comply with product restrictions; or

  • Events outside BetBox’s reasonable control.

Where liability cannot be excluded, BetBox’s liability will be limited to the maximum extent permitted by law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold BetBox harmless from claims, damages, losses, liabilities, and reasonable costs arising from:

  • Your unlawful use of BetBox;

  • Your material breach of these Terms;

  • False information provided by you;

  • Your unauthorised use of another person’s information, mobile number, card, or account; or

  • Your infringement of another person’s rights.

17. Suspension and Termination

BetBox may suspend, restrict, or terminate your access where we reasonably believe that:

  • You violated these Terms;

  • Your activity is fraudulent, abusive, or unlawful;

  • Suspension is required by a partner, regulator, court, or law enforcement agency;

  • Your activity creates a security or compliance risk; or

  • Suspension is necessary to protect BetBox, its partners, or other users.

Provisions intended by their nature to survive termination will remain effective.

18. Changes to These Terms

BetBox may update these Terms periodically.

The revised Terms will be posted with an updated effective date. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

Material changes to the text messaging program will not expand the scope of your messaging consent without any additional consent required by law or industry rules.

19. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict-of-law principles.

Subject to applicable consumer rights, legal proceedings relating to these Terms must be brought in the state or federal courts located in Danville California.

20. General Provisions

If any provision is found unenforceable, the remaining provisions will continue in effect.

BetBox’s failure to enforce a provision is not a waiver.

You may not assign your rights under these Terms without BetBox’s written consent. BetBox may assign these Terms as part of a merger, financing, corporate restructuring, or sale of its business or assets.

These Terms, the Privacy Policy, applicable transaction disclosures, and any product-specific agreement constitute the relevant agreement between you and BetBox.
